A summary of key age legislation relating to the higher education sector
- The regulations aim to prevent unfair treatment of staff and students due to their chronological age unless the treatment can be shown to be a proportionate way of achieving a legitimate aim.
- The regulations also protect against discrimination on the grounds of an individual's apparent age. They cover all phases of the relationship, from advertisement through to the ending of the relationship, and include training and development opportunities.
- Currently this legislation applies only to employees and those in receipt of educational services, but the proposed Equality Bill aims to extend this protection to cover the supply of goods, facilities and other services, with exemptions only for actuarially justified circumstances.
- As the legislation is quite new, the implications are still being determined in the courts, and case law will inform definitions and practice.
